Terms of Service
These Terms of Service ("Terms") govern your use of the SkateBits mobile application, website, and related services (collectively, "SkateBits" or the "Service"). By creating an account or using SkateBits, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
SkateBits is available to users 13 years of age or older. By using the Service you confirm you meet this minimum age. If you are between 13 and the age of majority in your country, you confirm a parent or legal guardian has reviewed and consents to these Terms on your behalf.
2. Your Account
You are responsible for the credentials you create and the activity that happens under your account. Notify us promptly at hello@skatebits.app if you suspect unauthorized access. You may delete your account at any time from Profile → Settings → Delete Account.
3. Acceptable Use
SkateBits is a live multiplayer game. While using video, voice, chat, profile fields, or any other part of the Service, you agree NOT to:
- Stream or post nudity, sexual content, or sexually suggestive material
- Harass, threaten, bully, stalk, or hate-speech other users
- Stream illegal activity or content depicting violence, self-harm, or abuse
- Impersonate another person or misrepresent your identity
- Post or transmit content you don't have the right to share, including copyrighted material
- Spam, scam, or solicit other users
- Disrupt the Service, attempt to access other accounts, reverse-engineer the app, or bypass security
- Use automated systems (bots, scrapers) to interact with the Service
- Encourage or perform skating in clearly unsafe locations (highways, private property without permission, etc.)
We may remove content, suspend, or permanently terminate accounts that violate these rules, with or without notice. Severe or repeat violations may be reported to law enforcement.
4. Physical Safety
Skateboarding involves physical risk. SkateBits encourages you to attempt tricks on camera, but you are solely responsible for your own safety, your environment, and any injuries or property damage that result from your use of the Service. Wear protective gear, choose appropriate locations, and follow local laws. Do not skate while operating a vehicle or in traffic. SkateBits is not liable for any physical injury or damage arising from your participation.
5. User Content
You retain ownership of the content you create — your camera and microphone streams, chat messages, profile information, and game data ("User Content"). By submitting User Content, you grant SkateBits a worldwide, non-exclusive, royalty-free license to host, transmit, display, and route that content as needed to operate the Service. This license ends when you delete your content or account, except as needed to comply with law or to retain backup copies for a reasonable period.
You are solely responsible for your User Content and you represent that you have all rights necessary to share it.
6. SkateBits Pro (In-App Purchases)
SkateBits offers an optional paid subscription, "SkateBits Pro," via Apple's in-app purchase system. By purchasing Pro, you agree to:
- Billing. Apple charges your Apple ID at confirmation and at each renewal period.
- Auto-renewal. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
- Cancellation. You can cancel anytime in Settings → Apple ID → Subscriptions on your device. Cancellation takes effect at the end of the current billing period.
- Refunds. All refunds are handled by Apple per their refund policy.
- Pricing changes. We may change subscription prices. Changes apply only to renewals after we've notified you.
7. Copyright (DMCA)
We respect intellectual property rights. If you believe content on SkateBits infringes your copyright, send a notice to hello@skatebits.app that includes: (a) a description of the copyrighted work, (b) the location of the allegedly infringing material on SkateBits, (c) your contact information, (d) a statement that you have a good-faith belief the use is not authorized, (e) a statement under penalty of perjury that the information is accurate and that you are the rights holder or authorized to act on their behalf, and (f) your physical or electronic signature. We will respond per the DMCA process and may remove content and terminate repeat infringers.
8. Reporting Illegal Content (EU Digital Services Act)
Users in the European Union may report content they consider illegal under EU or member-state law by emailing hello@skatebits.app with: a description of the content, its location in the Service, why you believe it is illegal, and your contact information. We will assess such notices in good faith and inform you of the outcome. Affected users will be notified when content is removed and may submit complaints to the same address. This complies with Article 16 of Regulation (EU) 2022/2065.
9. Moderation
We may review, remove, or restrict access to any User Content that we believe violates these Terms or applicable law, at our discretion. We are not obligated to monitor live streams or chat in real time. Removal decisions consider the severity, recurrence, and context of the violation. If your content or account is removed, we will tell you the reason where reasonably possible, and you may contest the decision by emailing hello@skatebits.app.
10. Termination
You may stop using SkateBits at any time. We may suspend or terminate your access immediately for any breach of these Terms, for safety reasons, or to comply with the law. Sections covering ownership, disclaimers, liability, indemnity, and dispute resolution survive termination.
11. Disclaimer of Warranties
SkateBits is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, SkateBits and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses arising from your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid SkateBits in the 12 months before the claim arose, or (b) USD $50.
Nothing in these Terms limits liability that cannot be limited by law, including liability for gross negligence, fraud, or death or personal injury caused by our negligence.
13. Indemnification
You agree to indemnify and hold harmless SkateBits, its affiliates, and personnel from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. You and SkateBits agree to resolve any dispute through binding individual arbitration in San Francisco County, California, under the rules of JAMS, except that either party may bring small-claims matters in their local courts. You and SkateBits waive any right to a jury trial and to participate in a class action.
Consumers in the European Union, United Kingdom, or other jurisdictions where such provisions are unenforceable retain their statutory rights to local courts and protections.
15. Apple-Specific Terms
If you obtained SkateBits from the Apple App Store, you also agree that:
- These Terms are between you and SkateBits, not Apple. Apple is not responsible for the Service or its content.
- The license granted to you is limited to the usage rights set forth in Apple's standard EULA, except where these Terms grant broader use.
- Apple has no obligation to provide maintenance or support for SkateBits.
- If SkateBits fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; otherwise Apple has no warranty obligation.
- Apple is a third-party beneficiary of these Terms and may enforce them against you.
16. Changes to These Terms
We may update these Terms as the Service evolves. Material changes will be announced in the app or on this page, and the "Effective date" above will be updated. Your continued use after changes take effect constitutes acceptance.
